Stallion Service Contract

This certifies _____________________________________ , hereafter referred to as mare owner, has engaged one service to RC Zippin Dot Com, Reg. # 498,232 for the mare _________________________________________, Reg. No. ______________________ for the 2008 breeding season at $800.00(US). Chafin‘s Painted Acres, is Owner of above named stallion, will herein be referred to as breeder.
1. A booking fee of $350.00 is payable with this contract and the balance of $450.00, plus all unpaid expenses will be payable upon receipt of an invoice or when the mare leaves the farm, or prior to shipment if shipped semen is needed, whichever is first. No mare will be live covered. In the event breeding is purchased through a stallion service auction a $150 non refundable chute fee is applicable for all contracts. The Breeder requires 48 hours advance notice when the Mare Owner wishes to remove his mare (s) from the farm. This will allow sufficient time to prepare the final statement so the Owner may settle his account. The Booking fee is non-refundable. 18% Interest will be charged on all accounts in excess of thirty days.
2. A copy of registration papers (both sides), a veterinarian's health certificate, including uterine culture, worming, and immunization records. If these are not presented upon mare's arrival, the Breeder shall have the attending veterinarian make proper tests and evaluations at the Mare Owner's expense. Tetanus and sleeping sickness injections shall be administered while the mare is being bred at Mare Owner's expense. Flu and rhinopneumonitis vaccine must be given before the mare arrives. A current Coggins test shall be furnished upon delivery of mare to the breeding farm. The owner/agent will need to obtain a negative EVA test on any mare brought to the farm for breeding.
3. The Mare Owner shall agree that each mare offered for breeding shall be in sound breeding condition and free from infection or disease. Any mare certified by the attending veterinarian not to be, in his opinion, in sound breeding condition, shall not be bred. Mare Owner may substitute another mare within that breeding season.
4. The Breeder agrees to diligently try and settle the above named mare and shall have sole discretion of determining the best method of breeding such mare. If however, the mare does not settle, the Breeder shall be held harmless. There will be no guarantee of a live foal for any mare leaving Chafin’s Painted Acres on or before being checked safe in foal by the attending veterinarian.
5. Live Foal Guarantee. Live foal means the foal shall stand and nurse. It is understood that if the mare proves barren, aborts her foal or if the foal is stillborn, a return season will be guaranteed the following year only, providing proper notification is given. Proper notification shall be defined as follows: Written certification by a licensed veterinarian within seven days that the mare has slipped or produced a non-viable foal. Mare Owner certifies that such abortion or death did not result from any act or omission of the Owner subsequent to the mares departure from Chafin‘s Painted Acres. A breeders certificate will be issued to mare Owner after all expenses have been paid in full and upon notification of birth of the foal.
6. Color Foal Guarantee: If the resulting foal is not eligible for regular paint registry, the mare may be rebred in the current season, provided the shipped semen fee of $225 is paid. This will cover shipping and collection. Shipping will be $225 after if needed. In the event that said mare cannot be rebred in the current year because of extenuating circumstances, owner can transfer of the rebreed to ONLY the following year. If mare does not take in the time allotted, then a $200 fee will be charged to extend the contract to the following breeding season. Should the mare owner request this option, the stallion owner must be notified of the reasons for this request with in 2 weeks of birth. A breeders certificate will be issued to mare Owner after all expenses have been paid in full and upon notification of birth of the foal.
7. Waiver of Liability. It is understood that the breeding farm, its owners, employees, veterinarians, and guests shall not be liable for any injury, escape, disability, or death of any horse on its premises. The above named Mare Owner, whose horse (s) are under the care of Chafin’s Painted Acres will not be liable or responsible for any damage, injury or death to the breeding farm stallions, employees, veterinarians, or other animals in the care of Chafin’s Painted Acres whether or not caused by his horse.
8. The breeding season shall begin Feb.1st and close July 1st of the year covered by this contract. Shall the said mare need semen on a date not covered by this contract, an additional $150 collection charge will be charged to the mare owner. It is further agreed that should the above named stallion die, or become unfit for service; or, if the above named mare dies, during the breeding season then the Mare Owner may substitute another mare or breed the above named mare to another stallion on the farm that is agreed to by both the Mare Owner and Breeder.
9. Mare owner or a representative may pick up semen at farm.
10. Orders for shipments are filled on a first come, first served basis. Orders placed after 8:00 am Pacific Standard time on the day of the collection cannot be guaranteed. The mare owner is responsible for shipping charges for cancellations received after shipment has already been sent. Shipment orders cannot be guaranteed if they are placed via e-mail, you must call to confirm. Semen is collected Monday, Wednesday, and Friday only.
11. When the above named Mare Owner signs and returns one copy of this contract to the Breeder it will then be a binding contract on both parties, subject to the terms and conditions. Under Oregon Law This contract is not valid unless completed in full.
12. All payments may be made by Check, Visa, MasterCard or American Express and all funds must be US. If paying by check leave Credit Card form blank. First shipment of semen is included in stud fee, additional shipments needed are $225 per shipment. Canada shipments are $275 per shipment.
